Waters of the United States

The Navigable Waters Protection Rule put in place by the previous administration on April 21, 2020 was suspended on August 30, 2021 by a U.S. district Court in Arizona. At the federal level, the U.S. Army Corps of Engineers and the U.S. Environmental Protection Agency will go back to the WOTUS definition developed and used up to 2015 (Bush Administration Definition and Rule). A new rule/definition was proposed on December 7, 2021 and the public comment period is open until February 7, 2022. More information can be found here.

Indiana Construction Stormwater General Permit (CSGP)
Indiana Municipal Separate Stormwater Sewer System (MS4) General Permit

As of December 18, 2021, Indiana no longer administers the construction stormwater program or the municipal stormwater program under Indiana Administrative Code (327 IAC 15-5 (Rule 5) or 327-15-13 (Rule 13)). Permit coverage is now issued under the Construction Stormwater General Permit (CSGP) and the Municipal Separate Storm Sewer System (MS4) General Permit. For more information see: IDEM: Storm Water Permitting: Stormwater Program Transition to Master General Permits
